Legal Prompt Engineering: The link between GenAI and legal practice

Generative artificial intelligence refers to technologies (e.g. ChatGPT, Bard, Falcon, Bloom Llama) that are able to independently generate new data, texts, images, videos and simulations.The algorithms used by these technologies are based on large language models (LLM) – part of machine learning (“ML”) – which learn from existing data, recognise patterns and improve their performance in specific tasks over time without being specifically programmed.

An important success factor for the use of generative AI is prompt engineering. Prompting is the act of providing specific and precise instructions or queries to LLM (e.g. ChatGPT, Harvey AI) to guide the model to produce desired  results or outputs. Targeted prompting can optimize the performance and relevance of AI model outputs to produce high-quality results.

The benefits of using GenAI technologies are not limited to individual employees or departments, but extend to the entire company. The work of the legal department can also be optimized by GenAI technologies  specifically designed for legal work (e.g. Harvey). These legal GenAI tools are trained with legal data and support the legal department in various ways, e.g. in simplifying and summarizing complex matters,  legal research , up to the creation of complete contracts. In addition to increasing employee satisfaction by making processes more efficient and assisting with otherwise time-consuming activities, conscious and informed use can reduce errors and improve the quality of work results. To achieve this, it is important to enable users through training in legal prompting – prompt engineering in a legal context.
